Terms of Service
These Terms and Conditions govern access to and use of the Zenqui website, member portal, digital platform, content, subscriptions, products, communications, and related services.
Zenqui is a company organized under the laws of the Republic of Colombia, identified with NIT . In these Terms, “Zenqui,” “we,” “us,” and “our” refer to that company.
Our website is www.zenqui.co. Questions concerning these Terms may be sent to info@zenqui.co.
By creating an account, purchasing a subscription, accessing paid or free content, or otherwise using Zenqui, you confirm that you have read, understood, and agreed to these Terms.
1. Acceptance of the Terms
These Terms constitute a legally binding agreement between you and Zenqui. You may not use the Services unless you agree to these Terms and our Privacy Policy. Electronic acceptance has the same effect as a handwritten signature to the extent permitted by law.
2. The Zenqui Services
Zenqui is a wellness and personal-development platform that may provide:
- Guided meditations and mindfulness exercises;
- Breathing and relaxation exercises;
- Sleep-related wellness content;
- Journaling tools, prompts, gratitude practices, affirmations, and inspirational content;
- Mood, emotional, habit, and wellness tracking;
- Educational articles and resources;
- Downloadable digital products;
- Membership features and email communications; and
- Other wellness-related content and functionality.
Features may vary by location, device, subscription plan, and platform version. Zenqui may add, modify, suspend, or discontinue features where reasonably necessary and subject to applicable law.
3. Wellness Service Only
Zenqui is provided exclusively for general wellness, educational, informational, mindfulness, and personal-development purposes.
Zenqui does not provide medical care, psychotherapy, psychiatric treatment, diagnosis, clinical counseling, medical assessment, crisis intervention, emergency services, prescription advice, or any substitute for care from a qualified professional.
Mood entries, journal entries, sleep information, self-assessments, and similar inputs are personal-reflection tools only. Zenqui does not clinically evaluate, validate, interpret, or diagnose users based on this information.
4. Medical and Mental-Health Disclaimer
Zenqui content is not intended to diagnose, treat, cure, or prevent any illness, disease, mental-health condition, sleep disorder, or medical condition.
Always consult an appropriately qualified physician, psychologist, psychiatrist, therapist, or other licensed professional concerning physical or mental-health concerns. Do not disregard, delay, or discontinue professional advice because of information presented through Zenqui.
Use of Zenqui does not create a doctor-patient, therapist-client, psychologist-patient, counselor-client, or other healthcare relationship.
5. No Emergency or Crisis Services
Zenqui is not an emergency-response, crisis-intervention, or suicide-prevention service. Zenqui does not continuously monitor journal entries, mood entries, account activity, or user content for signs of danger, abuse, self-harm, or medical emergencies.
If you or another person may be in immediate danger, may harm themselves or others, or is experiencing a medical or mental-health emergency, contact the emergency services applicable to your location immediately.
6. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract. By using Zenqui, you represent that you meet these requirements and that your use is lawful.
7. User Accounts
You agree to provide accurate information, maintain the confidentiality of your login credentials, use a strong password, avoid sharing your account, and promptly report suspected unauthorized access.
You may not impersonate another person, create an account using another person’s information without authorization, or transfer or sell your account.
8. Monthly Subscriptions
Zenqui may offer monthly paid memberships. The price, currency, billing interval, included features, and applicable taxes will be displayed before purchase.
By subscribing, you authorize Zenqui and its payment providers to charge your selected payment method. Unless otherwise stated, subscriptions begin when payment is processed, renew automatically each month, and continue until canceled.
9. Automatic Renewal and Cancellation
You may cancel through the cancellation functionality in your account or by contacting info@zenqui.co.
Cancellation prevents future renewals. Unless mandatory law requires otherwise, cancellation does not create a refund or prorated credit for the current billing period. You may ordinarily continue using paid Services until the end of the period already paid for.
Deleting an application, ceasing use, or failing to log in does not automatically cancel a subscription.
10. No-Refund Policy
Except where mandatory law provides otherwise, payments are final and non-refundable once access to the subscription, service, or digital content has been granted.
Zenqui does not ordinarily provide refunds for unused time, failure to use the Services, forgetting to cancel, dissatisfaction with subjective wellness outcomes, or digital content already accessed or downloaded.
Nothing in this section waives or restricts any non-waivable consumer right, including any applicable right of withdrawal, payment reversal, statutory refund, warranty, or remedy for defective, unavailable, unauthorized, incorrectly described, or undelivered services.
11. Payment Processing
Payments may be processed through Stripe, PayPal, Wompi, or another provider identified during checkout. Payment providers process payment information under their own terms and privacy policies.
Zenqui does not necessarily receive or store complete payment-card details. If a payment fails, Zenqui may retry the payment, request another method, suspend paid access, or cancel the subscription.
12. Prices, Taxes, and Currency
Prices are shown before purchase and may be subject to taxes, currency conversion, bank charges, or payment-provider fees. Zenqui may change prices prospectively and will provide any notice required by law.
13. Digital Products and Downloads
Zenqui may sell or provide ebooks, guides, worksheets, journals, audio, video, templates, courses, and other digital products.
Unless expressly stated otherwise, such products are licensed for personal, limited, non-exclusive, non-transferable use. They may not be copied, resold, sublicensed, redistributed, publicly posted, or commercially exploited.
14. Free Content and Promotional Offers
Zenqui may provide free content, trials, discounts, or promotional pricing subject to eligibility requirements, expiration dates, and conditions disclosed with the offer.
15. Journal Entries and User Content
You retain ownership of original content you submit. You grant Zenqui a limited, non-exclusive license to host, store, reproduce, format, transmit, and technically process that content only as reasonably necessary to operate the Services, display content to you, synchronize data, maintain backups, protect the platform, comply with law, and provide requested features.
Zenqui does not claim ownership of private journal entries.
16. Privacy of Journal and Wellness Information
Journal entries and wellness records are intended to be accessible only through authorized platform functions and authorized personnel where operational access is necessary. No internet-based system can be guaranteed completely private or secure.
17. User Responsibilities
You are responsible for deciding whether Zenqui is appropriate for your circumstances, seeking professional help when necessary, using exercises safely, maintaining device security, preserving copies of important information, and complying with local law.
18. Prohibited Conduct
You may not use Zenqui unlawfully, attempt unauthorized access, circumvent security or subscription controls, introduce malware, scrape data without permission, reverse engineer the platform except where law permits, redistribute Zenqui content, resell subscriptions, misuse payment methods, infringe rights, interfere with platform operation, or misrepresent Zenqui content as professional medical or therapeutic advice.
19. Intellectual Property
Zenqui and its licensors own the platform, brand, logos, visual identity, software, databases, meditation scripts, audio, video, guides, prompts, graphics, product descriptions, course structures, and the selection and presentation of content, except for user-owned content.
No intellectual-property rights are granted except the limited rights expressly stated in these Terms.
20. Third-Party Materials and Links
Zenqui may link to third-party websites, products, tools, payment services, or resources. Third-party services are governed by their own terms and privacy policies. A link does not necessarily constitute endorsement.
21. Email and Marketing Communications
Zenqui may send service-related communications necessary to manage your account, subscription, security, payments, or requested services.
Marketing communications will be sent only where you have opted in or another lawful basis applies. You may unsubscribe through the email link or by contacting info@zenqui.co.
22. Service Availability and Modifications
Zenqui aims to provide reliable access but does not guarantee uninterrupted or error-free operation. Access may be affected by maintenance, updates, hosting failures, internet disruptions, cybersecurity incidents, payment-provider failures, device incompatibility, force majeure, legal changes, or events beyond reasonable control.
23. No Guarantee of Results
Wellness outcomes vary. Zenqui does not guarantee reduced stress, improved sleep, increased self-esteem, improved mood, successful habit formation, medical or psychological improvement, or any particular result.
24. Suspension and Termination
Zenqui may suspend, restrict, or terminate access because of material breach, failed payment, suspected fraud, security risk, legal obligation, or discontinuation of a Service. Where appropriate and required by law, Zenqui will provide notice and a reasonable opportunity to remedy the issue.
25. Account Deletion
You may request account deletion through platform functionality or by emailing info@zenqui.co. Zenqui may verify your identity before processing the request.
Deletion may permanently remove access to journal entries, mood and sleep records, progress history, preferences, account-linked products, and other account information. Account deletion does not automatically create a refund or cancel a separately managed recurring payment.
26. Disclaimer of Warranties
To the maximum extent permitted by law, Zenqui is provided on an “as available” basis. Zenqui does not warrant continuous availability, error-free operation, universal suitability, uninterrupted notifications, immediate correction of defects, or permanent preservation of data.
27. Limitation of Liability
To the maximum extent permitted by law, Zenqui and its directors, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including loss of data, opportunity, goodwill, revenue, or anticipated benefit.
Where liability may lawfully be limited, Zenqui’s aggregate liability arising from a paid Service will not exceed the amount paid by the user during the six months preceding the event giving rise to the claim.
28. Indemnification
To the extent permitted by law, you agree to indemnify Zenqui against third-party claims arising directly from your unlawful use, material breach, rights-infringing content, or fraudulent conduct. This does not apply to the extent a claim was caused by Zenqui’s own unlawful conduct, negligence, or breach.
29. Consumer Rights
Nothing in these Terms waives or reduces rights granted by mandatory consumer law. Where Colombian consumer-protection law applies, all non-waivable rights remain available.
30. Complaints and Customer Support
Requests may be submitted to info@zenqui.co. Include enough information to identify the account, transaction, issue, and requested resolution.
31. Governing Law
These Terms are governed by the laws of the Republic of Colombia, without prejudice to mandatory consumer protections applicable in the user’s place of residence.
32. Dispute Resolution and Jurisdiction
The parties should first attempt to resolve disputes in good faith through written communication. Unresolved disputes may be submitted to the competent courts or administrative authorities of Colombia, subject to mandatory jurisdictional or consumer-protection rules.
33. Changes to These Terms
Zenqui may update these Terms to reflect changes to the Services, legal requirements, security needs, business practices, or clarifications. Material changes will be notified as required by law.
34. Assignment
You may not transfer your account or assign rights under these Terms without Zenqui’s written consent. Zenqui may assign these Terms in connection with a merger, acquisition, restructuring, sale of assets, or transfer of the Zenqui business.
35. Severability
If any provision is invalid or unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue in effect.
36. No Waiver
Failure to enforce a provision does not waive the right to enforce it later.
37. Entire Agreement
These Terms, the Privacy Policy, checkout disclosures, and any product-specific terms constitute the complete agreement concerning use of Zenqui.
38. Language
These Terms may be available in English and Spanish. If an inconsistency arises, the Spanish-language version will govern to the extent permitted by law.
